These Terms and Conditions ("Terms") govern your access to and use of AVD Metal Tech Fuel Station Construction & Partnership Program and related services. By applying for or participating in our program for building, partnering on, or dealership collaboration for fuel stations (similar to HPCL, BPCL, and Bharat eco-fuel models), you agree to comply with these Terms.
1. Eligibility
Applicants must meet the eligibility criteria as defined by AVD Metal Tech, including financial capacity, suitable land availability (as per petroleum retail norms), proper documentation (land title, NOC, approvals), technical expertise or partnership readiness, and full compliance with applicable government norms (including PESO, OISD, MoPNG guidelines for fuel retail outlets).
2. Application Process
All applicants are required to submit accurate, complete, and up-to-date information, including site plans, feasibility reports, and regulatory clearances where applicable. Providing false or misleading details may result in rejection of the application or termination of the partnership/dealership agreement.
3. Responsibilities of Partnership/Dealership Holders
- Provide suitable land and necessary statutory approvals for fuel station construction.
- Collaborate in the end-to-end development process, including design, metal fabrication, canopy installation, civil works, dispenser setup, and safety systems as per AVD Metal Tech standards.
- Comply with all legal, environmental (including eco-fuel compatible designs), PESO/OISD safety, and petroleum regulations.
- Maintain project timelines, quality standards, and post-construction operational requirements (if applicable under dealership model).
- Ensure staff and contractors are trained as per AVD Metal Tech and industry guidelines for fuel station safety and operations.
4. Pricing & Payment
Project pricing, construction costs, and material/fabrication charges will be determined and revised periodically by AVD Metal Tech based on scope, materials, and market conditions. All payments must be made strictly as per agreed milestones and terms through authorized payment channels.
5. Intellectual Property
All designs, blueprints, proprietary fabrication techniques, branding elements, trademarks, and materials provided by AVD Metal Tech remain the exclusive intellectual property of the company and may not be used, replicated, or shared for unauthorized purposes or third-party projects.
6. Termination
AVD Metal Tech reserves the right to suspend or terminate the partnership, construction contract, or dealership collaboration in case of breach of terms, fraudulent activity, non-compliance with regulations, illegal practices, failure to secure approvals, or consistent underperformance/project delays.
7. Amendments
These Terms & Conditions may be updated from time to time to reflect changes in regulations, technology, or company policies. Any significant changes will be communicated through official channels.
8. Limitation of Liability
AVD Metal Tech shall not be liable for any indirect, incidental, or consequential damages arising from fuel station construction, operations, regulatory delays, or related business activities. Liability is limited to the value of the contracted services provided.
9. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in Delhi/Noida (or as per company registration/location).
